1. Entity Notice

Colby Auto Investments LLC (“Colby Auto,” “we,” “us,” or “our”) is the contracting and purchasing entity for all vehicle acquisition transactions.

VehicleBuyers.com LLC is a marketing and lead-generation platform only and is not a purchasing party, contracting party, or financial obligor for any vehicle purchase agreements.

All offers, purchase contracts, payments, cancellations, and refunds are issued exclusively by Colby Auto Investments LLC.

2. Acceptance of Terms

By engaging with Colby Auto Investments LLC—whether through VehicleBuyers.com, by phone, email, text message, or in person—you agree to these Terms & Conditions.

These Terms apply to all customers, sellers, and any party participating in a vehicle sale transaction with Colby Auto.

Colby Auto Investments LLC reserves the right to update or modify these Terms at any time. The version in effect at the time of your transaction will govern that transaction.

3. Transaction Overview

A “transaction” includes any agreement—verbal, written, or electronic—to sell a vehicle to Colby Auto Investments LLC.

A transaction is considered completed when both of the following have occurred:

  • Payment has been issued to the seller; and

  • Legal ownership has transferred, including execution of the title and any required supporting documents.

Once a transaction is completed, it is generally final and non-cancelable, except where required by applicable law.

4. Cancellation Policy

4.1 Eligibility for Cancellation

A cancellation request may be submitted only before:

  • Payment is issued, and

  • Legal ownership of the vehicle transfers to Colby Auto Investments LLC.

After these steps occur, cancellation is typically not permitted.

4.2 Review and Approval

All cancellation requests are reviewed case-by-case.

Colby Auto Investments LLC:

  • Retains full discretion to approve or deny cancellation requests;

  • May deny cancellation if payment has been processed, documents executed, or vehicle pickup/transport is scheduled or completed;

  • Will comply with all applicable federal, state, and local laws.

4.3 Transaction Finality

Once payment is completed and ownership transfers, the transaction is generally final, unless cancellation is legally required.

5. Refund Policy

5.1 When Refunds May Be Issued

Refunds may be issued only under the following circumstances:

  • The transaction was canceled before completion;

  • An overpayment or duplicate payment occurred;

  • Colby Auto Investments LLC determines a refund is appropriate based on the specific facts of the situation.

5.2 Refund Method and Timing

Approved refunds will:

  • Be issued to the original form of payment;

  • Be processed within a reasonable timeframe, typically 3–10 business days;

  • Include written confirmation for customer records.

5.3 Refund Limitations

  • Refunds are not available once a vehicle sale is completed, except where required by law.

  • Colby Auto is not responsible for refunds related to misrepresentation or undisclosed vehicle issues after completion, unless required by law or explicitly agreed to in writing.

6. Customer Responsibilities

Customers are responsible for:

  • Providing accurate and truthful vehicle information;

  • Confirming legal authority to sell the vehicle;

  • Reviewing all documentation before signing;

  • Communicating promptly regarding cancellations or changes.

Failure to meet these responsibilities may affect eligibility for cancellation or refund.

7. Inspection and Verification

Colby Auto Investments LLC may inspect or verify a vehicle prior to completion.

If material discrepancies are discovered (including condition, title issues, or undisclosed damage), Colby Auto may:

  • Adjust the offer price;

  • Decline the transaction;

  • Cancel the transaction without penalty;

  • Return the vehicle, if feasible and appropriate.

8. Limitation of Liability

To the fullest extent permitted by law:

  • Colby Auto Investments LLC is not liable for indirect, incidental, special, or consequential damages.

  • Liability is limited to the original agreed-upon purchase price of the vehicle.

This limitation does not apply where prohibited by law.

9. Compliance with Laws

All transactions are subject to applicable:

  • Federal laws;

  • State motor vehicle and title regulations;

  • Lien requirements;

  • Consumer protection statutes.

If any provision conflicts with applicable law, it will be modified to comply while the remaining Terms remain in full effect.
